Indian ship, the change of ownership must be endorsed on her certificate of registry, either by the registrar of the ship’s port of registry or by the registrar of any port at which the ship arrives, who in turn ought to have been advised of the said change, by the registrar of the ship’s port of registry.
The Master shall, for the purposes of such endorsement by the registrar of the ship’s port of registry, deliver the certificate of registry to the registrar forthwith after the change, if the change occurs when the ship is at her port of registry. If the change occurs during her absence from that port and the endorsement under this section is not made before her return, then the endorsement needs to be done, upon her first return to that port.Delivery of certificate of registry of ship being lost or if a ship ceases to be an Indian ship In the event of a registered ship being lost either “actually” or “constructively”, or is taken by the enemy, or burnt or broken up, or ceases for any reason to be an Indian ship, every owner of the ship or any share in the ship shall immediately on obtaining knowledge of the event, give a notice thereof to the registrar of her port of registry. The registrar shall make an entry thereof in the register book and the registry of the ship in that register, shall be considered as closed, other than any unsatisfied mortgages that might have had been entered therein.
In any such case, unless where the ship’s certificate of registry is mislaid, lost or destroyed, the Master of the ship shall:
- If the event occurs in any port in India, immediately;
- If the event occurs elsewhere, within ten days after his arrival in port, deliver the certificate to the registrar of that port, or any other officer specified in this regard by the Central Government if the port of arrival is in India, or, if the port of arrival is in any port outside India, to the Indian Consular Officer there, any of whom shall forthwith forward the certificate as delivered to him, to the registrar of her port of registry.
